IANAL but, the minute a bankruptcy is filed, does not all assets and
debits, all creditors freeze? I mean, the Russians evidently paid part
of a payment towards the install of SCO into their systems. They will
need to get a Linux vendor.
The money can be kept in the court, until all creditors are paid, and
the newest customers and creditors usually get nothing.
Then, too, Novell has a contract with SCO, dating back to 1995, and are
entitled to be paid 95% of that $16 million of Microsoft money, and 95%
of that $11 million from Sun, as they pre-date other deals, probably.
Anyway, I don't usually gloat over anyone going bankrupt, except I do
gloat when some pompous jerk like Daryl McBride steers SCO to sue
customers who are 50X bigger with tons of court experiences, a war chest
that is simply huge, and appear to definitely win!
Most of the Linux users, some 5,000 of whom got threatening extortion
letters from SCO will probably never get anything except a ton of
gleeful satisfaction.
